The Company name, the terms “Golden Corner,” “TGC,” www.tgcjewelers.com,  the “TGC” logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.

Please Note: Any watch brands and trademarks referenced in this Website are the property of their respective holders. The Golden Corner is not an "authorized" dealer of the watches we sell and has no affiliation with the respective manufacturers. The Golden Corner deals in secondhand watches, not watches considered "new." Unless expressly indicated otherwise, any references in this Website to a watch as "new" shall be deemed to mean that the watch is unworn by the prior owner; no references in this Website shall be deemed to imply that the watch is new directly from the manufacturer.

Prohibited Uses

You may use the Website only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Website:

Order Acceptance and Cancellation.

You agree that your order is an offer to buy, under these Terms of Use, all products and services listed in your order. All orders must be accepted by us, or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you have ordered. In such event, we shall cancel your order and, if applicable, refund you any amounts charged. This section only applies to cancellations and refunds initiated by TGC, not by you. For information on cancellations, returns, and/or refunds initiated by you, please refer to the section below on Returns and Refunds.

Prices and Payment Terms.

Prices posted on this Website may be different from prices offered by us at 15482 NW 77^th CT, MIAMI LAKES, FL 33016. All prices, discounts, and promotions posted on this Website are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping, handling, and insurance. All such taxes and charges will be added to your merchandise total and will be itemized in your shopping cart and your order confirmation email. We strive to display accurate price information, however, we may, on occasion, make inadvertent typographical errors, inaccuracies, or omissions related to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any orders arising from such occurrences.

Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us before we accept an order. Except as otherwise provided herein, we accept PayPal, Visa, Mastercard, and American Express for all purchases. Please note that we may charge a Convenience Fee between 2% and 5% of the total amounts paid with a credit card. You represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping, handling, and insurance charges and all applicable taxes, if any, regardless of the amount quoted on the Website at the time of your order. In accordance with applicable laws and regulations, any instances of credit card chargeback fraud shall be subject to thorough investigation and prosecution to the fullest extent permitted by law.

Notwithstanding the foregoing, TGC may, at TGC’s sole and absolute discretion, require that any transactions over ten thousand dollars ($10,000.00) be made via bank/wire transfer. To that end, you will be asked to provide one or more forms of valid government-issued identification, and we will provide you with our account information for you to complete the bank/wire transfer. If we provide you with written account information, you are responsible for validating said account information by calling (305) 691-6175 and requesting to confirm payment information. PLEASE NOTE: THERE ARE SCAMMERS THAT INTERCEPT EMAILS WITH BANK TRANSFER INFORMATION. THEREFORE, THE GOLDEN CORNER SHALL NOT BE LIABLE OR RESPONSIBLE FOR PAYMENTS SENT TO THE INCORRECT ACCOUNT IF YOU FAIL TO CONTACT US VIA PHONE TO VERIFY THE BANK TRANSFER INFORMATION.

Shipments; Delivery; Title and Risk of Loss.

We will arrange for shipment of the products to you. Please check the individual product page for specific delivery options. You will pay all shipping, handling, and insurance charges specified during the ordering process. Shipping, handling, and insurance charges are reimbursement for the costs we incur in the processing, handling, packing, insuring, shipping, and delivery of your order. You agree to purchase insured shipping on all orders. Insured shipping provides coverage for the full value of the purchased items against loss, damage, or theft during transit. The cost of insured shipping may vary depending on the value of the items being purchased and will be added to the total order amount and is the responsibility of the purchaser.

Title and risk of loss pass to you upon our transfer of the products to the carrier. Upon shipping the item(s), we will provide you with tracking information and insurance information. Should any issues arise after we ship the item(s), it is your responsibility to initiate an insurance claim for the loss, damage, or theft of the item(s). Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

Returns and Refunds.

We want you to be happy with your purchase and wear it for years to come. But we also want you to feel comfortable purchasing from us. Should you need to return your item(s), then please note that returns may be accepted on the following terms and conditions:

• You MUST initiate the return within five (5) business days after the carrier delivers the item(s).
• To initiate a return, you MUST send an email to our Returns Department at Alain@TGCJewelers.com. The email MUST meet the following criteria:
  • The email MUST be sent from the email address to which we sent the confirmation email at the time the order was placed.
  • The subject line must state “RETURN REQUEST – Order No. [XXXXX]” with the bracketed portion stating the order number relating to the return.
  • The body of the email must state: (1) your order number, (2) the item you wish to return, (3) the reason for the return, and (4) a statement from you confirming that the item has not been worn or used since delivery.
• Upon receiving your return request email, we will respond within a reasonable time and will provide you with a quote for insuring and shipping the item(s) back to us. Moreover, depending on the circumstances, we may charge a restocking fee of up to ten percent (10%) at our sole and absolute discretion. You will not be asked to pay the return shipping quote at that time, only to confirm your agreement to be charged said amount as described below.
• Upon receiving your consent to the return quote, we will send you a return shipping label for you to ship the item(s) back to us.
• You MUST ship the item(s) back using only the return shipping label we provide you and in the original packaging, with all boxes, papers, labels, tags, and hangtags that were included with the item when we originally shipped it to you.
• Upon our receipt of the item(s), the item(s) will be thoroughly inspected by our in-house watchmaker and/or jeweler, as applicable, to ensure that the item in the same condition as it was when it was originally shipped to you.
  • Please note: we thoroughly inspect and document all items before shipping for our own internal controls. We will know if an item was worn, even once, or had any parts or portions modified, replaced, or swapped.
• If we confirm that the item(s) is/are in the same condition as when we first shipped to you, we will process a refund in the amount of the price of the item(s), less the cost of shipping, handling, and insurance to and from you and, if applicable, the restocking fee. The refund shall be made in the form of a credit back to the same form of payment used to place the order at the time of purchase.
• If our inspection reveals that the item(s) was/were worn or otherwise modified, we shall advise you of the same, and no refund shall be issued. However, you may request that the item(s) be shipped back to you, in which event, we shall send you an invoice for the cost that we incurred on the return (i.e. shipping and insurance), an inspection fee in an amount equal to ten percent (10%) of the value of the item(s), and the cost of shipping, handling, and insurance for the final shipment.

DO NOT SHIP YOUR ITEM(S) BACK TO US WITHOUT FOLLOWING THE PROCEDURE ABOVE. WE WILL NOT ACCEPT OR INITIATE REFUNDS OR RETURNS THAT FAIL TO FOLLOW THE PROCEDURE ABOVE.

WE OFFER NO REFUNDS ON ANY PRODUCTS DESIGNATED ON THIS SITE AS FINAL AND/OR NON-RETURNABLE.

Manufacturer's Warranty and Disclaimers.

We do not manufacture or control any of the products or services offered on our Website. The availability of products or services through our Website does not indicate an affiliation with or endorsement of any product, service, or manufacturer. Accordingly, we do not provide any warranties with respect to the products or services offered on our Website. However, some of the products and services offered on our Website may be covered by the manufacturer's warranty as detailed in the product's description on our Website and included with the product. To obtain warranty service for defective products, please follow the instructions included in the manufacturer's warranty.

All sales made through the Website are subject to the availability of inventory at The Golden Corner. By placing an order through the Website, you acknowledge and accept the possibility of inventory unavailability and agree to abide by the terms and conditions herein regarding order cancellations and substitutions.

Authenticity of Branded Products

The Golden Corner has been in business for over 35 years and has handled thousands of articles of jewelry and watches. We have built strong relationships with trusted providers to source our products, and we have all items thoroughly inspected by our trained in-house jewelers and watchmakers to ensure that every piece we sell is authentic, and that any aftermarket modifications are specifically noted in the description. However, in this day and age of “super-clones” and the like, we can never guarantee that an item may get passed our rigorous inspections. Therefore, we can never guarantee that an item is all or partially non-authentic. If upon delivery you discover that an item is not authentic, or that a portion of it that we did not disclose is not authentic, you may follow the procedure to initiate a return within five (5) business days of your receipt of the item. If you have any questions or doubts as to the authenticity of an item or portion thereof (i.e. whether a particular watch’s bezel is factory-set or aftermarket), please contact us at 305-691-6175 and we will be happy to assist you.

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Arbitration

At Company's sole discretion, it may require you to submit any disputes arising from these Terms of Use or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Florida law.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Waiver and Severability
